Terms and Conditions of Sale and Services

This English translation is provided for convenience. The French version of these terms prevails in the event of any discrepancy. Article 1 – Purpose These general terms and conditions of sale and services (the "Terms") define the contractual relationship between SAND SERVICES, whose registered office is located at 7 ZA La Lombardie, 298 Chemin des Colles, 83440 TOURRETTES, registered with the Trade and Companies Register of Draguignan under number R.C.S. 529 853 566, and the Customer (as defined in Article 2). These Terms apply to every purchase made through the website officecartegrise.fr, whether the customer is a professional or a consumer. The customer declares that they have read these Terms and accepted them without reservation before placing any order. Any purchase or acquisition of a service via officecartegrise.fr implies the customer's unreserved acceptance of these Terms. These Terms prevail over any other general or specific terms not expressly approved by SAND SERVICES. SAND SERVICES reserves the right to amend its terms of sale at any time. In that event, the applicable terms are those in force on the date the customer places their order. SAND SERVICES is appointed by the customer as part of a commercial intermediation service between the customer and the administration in order to obtain a vehicle registration certificate. SAND SERVICES cannot be regarded as the issuer or manufacturer of the registration certificate. Article 2 – Definitions - Terms and Conditions of Sale (Terms): the provisions governing subscription to a service offered on officecartegrise.fr and the rights and obligations of the parties. - Sales contract: the contract entered into through the officecartegrise.fr website. - Website: the website accessible at officecartegrise.fr. - Service: the online ordering and processing of a new vehicle registration certificate (carte grise). - Product: the vehicle registration certificate (carte grise). - VAT: Value Added Tax. - ANTS and SIV: the Agence Nationale des Titres Sécurisés and the Système d'Immatriculation des Véhicules, public bodies and systems under the authority of the French Ministry of the Interior. - SAND SERVICES: the service provider company (French Treasury accreditation No. 46489, Ministry of the Interior habilitation No. 188573) acting as a commercial intermediary between the SIV / ANTS and the Customer. - Customer: any natural or legal person subscribing to the paid Services offered on the Website. Article 3 – Characteristics of products and services The products and services offered appear on officecartegrise.fr. Each product or service is accompanied by a description. Photographs on the website are in no way contractual. These services consist of two stages: 1. File compliance check: verification of the documents submitted in accordance with the rules laid down by the Ministry of the Interior. The customer receives an email confirming compliance or a request to regularise missing or non-compliant documents. 2. Data registration: entry of the information in the SIV or with the ANTS. Following registration, the customer receives a registration acknowledgement / provisional title, or proof of a processing block if technical registration is impossible. SAND SERVICES does not intervene in the technical characteristics shown on titles. Any disagreement on this point must be raised directly with the SIV or the ANTS. Article 4 – Scope and territory Online sale of the services presented on officecartegrise.fr is reserved exclusively for customers residing in mainland France and the French overseas departments (DOM), and for deliveries within those geographical areas. Article 5 – Prices and additional fees Prices shown on the website are inclusive of all taxes (TTC) in euros, reflecting the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the services. SAND SERVICES reserves the right to change its prices at any time; the price shown on the website on the day of the order is the only one applicable. Prices do not include the fiscal tax (the statutory carte grise fee set by the State and the regions) or any specific shipping costs. Additional intervention fees: - An additional fee of €10.00 incl. VAT will be charged for any extra procedure required to process the file where an element was not specified by the customer at the time of ordering (e.g. technical modification of the vehicle, holder differing from the transfer certificate, incorrect tax simulation by the Customer). - An additional fee of €10.00 incl. VAT will be charged for any supplementary processing of an incomplete file, to cover archiving, follow-up and a full re-check of the file when the missing documents are received. SAND SERVICES cannot be held liable for changes to fees by the administration, calculation errors by the administration, or errors made by the customer in their declarations or payments. In such cases, the customer will be asked to pay the balance due to complete the procedure. Article 6 – Orders and account creation To place an order, the customer must create an account on the website by providing their surname, first name, email address and password. The email address serves as the account identifier. The customer is responsible for the confidentiality and use of their credentials. To finalise an order, the customer must: 1. Complete the online form. 2. Validate and confirm the order after checking it. 3. Make payment under the conditions provided. 4. Submit (by upload, email or post) all required supporting documents. Order confirmation constitutes acceptance of these Terms. By placing an order, the customer undertakes to provide original, non-falsified documents and true copies. Identity theft (Article 226-4-1 of the French Criminal Code) and use of forged documents (Articles 441-1 et seq. of the French Criminal Code) are punishable by law. Article 7 – Payment terms The service fee and the amount of the fiscal taxes are due upon ordering. Payment is made in euros, either online by bank card (Carte Bleue, Visa, Mastercard via the secure Sherlock / LCL 3X solution) or by bank transfer. An invoice is sent to the customer by email or is available in their customer account. SAND SERVICES reserves the right to suspend or cancel any order in the event of an unresolved prior payment dispute. Article 8 – Incomplete or blocked files - Incomplete files: Any return of an original document to the customer to complete a file will be sent by tracked mail and charged €9.00. If the file remains incomplete after follow-ups at the end of a one (1) month period, SAND SERVICES reserves the right to cancel the order. The fiscal tax will be refunded, but the service fees will remain due to SAND SERVICES to cover the verification work already undertaken. - Blocked files (SIV / CERT): In the event of a technical block requiring specific intervention with a Centre d'Expertise Ressources Titres (C.E.R.T.), an additional service of €10.00 incl. VAT will be offered to the customer. If the customer refuses, the file will be returned within 5 days, the fiscal tax refunded and the service processing fees retained. Article 9 – Delivery Printing and dispatch of the definitive title are handled directly by the Imprimerie Nationale by tracked mail to the address entered on the official Cerfa form. SAND SERVICES cannot be held liable for delivery delays attributable to La Poste, the Imprimerie Nationale or the operation of State services (SIV / ANTS). If mail is returned to SAND SERVICES because of an incomplete address or the recipient's unavailability, reshipment will be at the customer's expense (initial shipping costs plus €10 for return-management fees). Article 10 – Registration power of attorney By placing an order, the customer expressly authorises SAND SERVICES to carry out the administrative registration formalities on their behalf. This authorisation is formalised by the mandatory provision of Cerfa form No. 13757*01 duly signed by the customer. Article 11 – Right of withdrawal In accordance with Article L. 221-18 of the French Consumer Code, consumer customers have 14 days from order confirmation to exercise their right of withdrawal. Waiver of the right of withdrawal for immediate performance: Under Article L. 221-28 1° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services that have been fully performed before the end of the withdrawal period and whose performance began after the consumer's express prior agreement and express waiver of the right of withdrawal. If the customer requests immediate processing of their file before the end of the 14-day period (by ticking the dedicated box when placing the order), they expressly accept the start of the service and waive their right of withdrawal. If the compliance check has been carried out, the service fees remain due to SAND SERVICES; only the fiscal tax paid is refunded. In the event of a valid withdrawal where the service has not been performed, the refund will be made within a maximum of 14 days using the same payment method as for the order. Article 12 – Cancellation and refund outside withdrawal Any request to cancel an order must be sent by registered letter with acknowledgement of receipt. - If the file has not yet been processed and the request is made after the 14th day, cancellation results in retention of the service fees. The fiscal tax is fully refunded. - No cancellation is possible once a complete file has been registered in the SIV and the provisional/definitive title has been generated. Management fees on refunds of overpaid regional tax (where the error is attributable to the customer): - Between €1.00 and €100.00 overpaid: €9.90 management fee. - Between €100.01 and €200.00: €19.90 management fee. - Between €200.01 and €300.00: €29.90 management fee. - Above €300.00: €39.90 management fee. Returns of cancelled original files by post generate processing and reshipment fees of €10. Article 13 – Limitation of liability SAND SERVICES is bound by an obligation of means in processing files. It cannot be held liable for damage resulting from use of the Internet (outage, virus, data loss) or from a malfunction of public administration servers (SIV / ANTS). SAND SERVICES cannot be held liable for rejection decisions or delays by prefectural services or the CERT in processing a file. Article 14 – Personal data SAND SERVICES processes the customer's personal data in accordance with applicable regulations (GDPR and the French Data Protection Act). The information collected is strictly necessary for performance of the registration mandate and for customer-relationship management. Every Customer is invited to read the details on the "Personal Data Protection" / Privacy policy page of the officecartegrise.fr website. Article 15 – Archiving and Evidence SAND SERVICES will archive order forms and invoices on a reliable and durable medium constituting a faithful copy, in accordance with Article 1360 of the French Civil Code. SAND SERVICES' computerised records shall be regarded by the parties as evidence of the communications, orders, payments and transactions between them. Article 16 – Dispute resolution and Mediation These general terms and conditions of sale are subject to French law. The language of the contract is French. In the event of a complaint or dispute, the customer shall first contact SAND SERVICES to seek an amicable solution at the following address: SAND SERVICES – 7 ZA La Lombardie – 298 Chemin des Colles, 83440 TOURRETTES (or by email at: contact@officecartegrise.fr). In accordance with Articles L. 612-1 et seq. of the French Consumer Code, if the complaint to the seller fails or the seller does not respond within two (2) months, the consumer may free of charge refer the matter to a consumer mediator with a view to an amicable resolution of the dispute.
